Terms and Conditions for FE-1 Tuition

Effective date: 24 October 2025 · Last updated: 29 August 2026 · V3.0

1. Introduction

1.1. These Terms and Conditions (“Terms”) govern the supply of FE1 tuition services by Rody O’Brien Legal Education (“the Tutor”, “we”, “us”, “our”) to individual students (“the Client”, “Clients”, “you”, “your”).

1.2. By creating a subscription, registering for, or attending any tuition session, you confirm that you have read and understood these Terms in full and agree to be bound by them. If you do not accept these Terms, you must not register for or access tuition.

1.3. These Terms, together with our Privacy Policy referred to in Clause 13, constitute a legally binding agreement between you and Rody O’Brien Legal Education.

2. Nature of Services

2.1. Rody O’Brien Legal Education provides individual and/or small-group live online tuition sessions for the FE1 Examinations in Ireland.

2.2. Sessions are delivered live by a tutor, on a one-to-one or small-group basis, via Zoom, Microsoft Teams or another platform notified to the Client in advance, and typically last one hour unless otherwise agreed in writing. The service is a personally delivered, tutor-led educational service.

2.3. The services are for educational preparation only. Rody O’Brien Legal Education makes no guarantee as to examination results or outcomes.

2.4. Any notes, slides or recordings shared with the Client to support a live session are provided for that purpose only and are not sold or supplied as a standalone digital product.

3. Booking and Commitment

3.1. Tuition is provided on a recurring subscription basis, whereby Clients reserve weekly tuition slots in advance.

3.2. Your booking and payment secure your reserved tuition time each week. You are responsible for attending or providing timely cancellation notice under Clause 5.

3.3. The subscription continues on a rolling weekly basis until it ends under Clause 9 (Termination by the Tutor) or Clause 10 (Ending the Subscription).

4. Payment Terms

4.1. Students are billed weekly, in advance, for that week’s tuition. Payment is processed on a recurring basis through Stripe or another approved payment processor.

4.2. Each week’s payment is taken on the date agreed at signup and covers that week’s reserved session(s) only. If a payment fails or is declined, that week’s booking may be suspended until payment is successfully processed.

4.3. Save as set out in Clause 7 (Right of Withdrawal / Cooling-Off Period), fees for sessions already delivered are non-refundable. Tuition is a live, personally delivered educational service and is provided on the basis set out in these Terms.

4.4. Non-payment, failed payments, or chargebacks will be treated as a breach of contract, and the Tutor reserves the right to recover outstanding sums and any reasonable associated administrative or legal costs.

4.5. The Tutor may change fees for future sessions on at least 1 weeks written notice. A fee change applies only to sessions booked after that notice period and does not affect sessions already paid for.

5. Cancellation, Rescheduling and No-Shows

5.1 Client cancellations: Clients must give a minimum of 72 hours’ notice to cancel or reschedule a session.

5.2. Sessions cancelled with less than 72 hours’ notice, or in the event of a no-show, are forfeited and will not be refunded or credited.

5.3 Tutor cancellations: If a representative of Rody O’Brien Legal Education cancels a session, the Tutor will offer an alternative date and time and make reasonable efforts to reschedule promptly.

5.4. Rody O’Brien Legal Education reserves the right to terminate services for persistent cancellations or non-attendance by the Client, as set out in Clause 9.

6. Refund Policy

6.1. Save as set out in Clause 7, fees for sessions cancelled late, missed, or partially completed are non-refundable.

6.2. A payment reserves tuition time, not attendance at a specific session. Failure to attend, or a failure to give notice under Clause 5, does not entitle the Client to a refund.

6.3. No refund is provided once a session has commenced, or where the Client has not complied with these Terms, except as set out in Clause 7.

7. Right of Withdrawal / Cooling-Off Period

7.1. Where you enter into this agreement online or at a distance, you have a statutory right to withdraw from the contract within 14 days of the date the contract is formed, without giving a reason, under the Consumer Rights Act 2022.

7.2. If you ask for tuition to begin before this 14-day period has ended, we will ask you to make an express request to that effect (for example, by ticking the relevant box at signup). You acknowledge that: (a) if you withdraw before a session has been fully delivered, you will be charged, or refunded down to, an amount in proportion to the sessions actually delivered up to that point; and (b) once a session has been fully delivered with your express consent, the statutory right to withdraw no longer applies.

7.3. Once the initial 14-day period has passed without you exercising this right, it no longer applies, and cancellation of individual sessions, or of the subscription as a whole, is instead governed by Clause 5 (Cancellation, Rescheduling and No-Shows) and Clause 10 (Ending the Subscription).

8. Client Responsibilities

8.1. Clients must have a reliable internet connection, a functioning device, and a suitable environment for online learning.

8.2. The Client is responsible for attending sessions on time. A late arrival does not extend the scheduled end time.

8.3. Clients are expected to engage respectfully and professionally. Abusive, inappropriate, or disruptive behaviour will result in immediate termination of services without refund.

8.4. Clients must not record, reproduce, or distribute any tuition materials or session content without the Tutor’s prior written consent.

8.5. The Tutor may record sessions for quality, training, or reference purposes. Any such recording is processed in accordance with our Privacy Policy, and the Client will be told before a session is recorded.

9. Termination of Services by the Tutor

9.1. Rody O’Brien Legal Education may terminate the tuition agreement immediately where:

  • the Client fails to make timely payment;
  • the Client breaches these Terms; or
  • the Client behaves in a manner that is inappropriate, disrespectful, or harmful, or persistently cancels or fails to attend sessions (meaning, for this purpose, three or more late cancellations or no-shows within any rolling three-month period).

9.2. Upon termination, the Client remains liable for any outstanding fees for sessions already delivered.

9.3. Rody O’Brien Legal Education may also discontinue services at its discretion on reasonable notice if continuing the arrangement is no longer feasible.

9.4. Termination under this Clause does not affect fees already due for sessions delivered up to the date of termination, and Clause 6 (Refund Policy) continues to apply.

10. Ending the Subscription by the Client

10.1. The Client may end the ongoing subscription at any time by giving the Tutor at least four weeks written notice by email to [email protected]. The subscription ends, and no further payments are taken, from the end of that notice period.

10.2. Ending the subscription does not entitle the Client to a refund of fees already paid for sessions delivered, or already due, before the end of the notice period, and Clause 6 (Refund Policy) continues to apply.

10.3. This Clause does not affect the Client’s separate statutory right of withdrawal under Clause 7, where that right still applies.

11. Limitation of Liability

11.1. Nothing in these Terms excludes or limits the Tutor’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under Irish law.

11.2. Subject to Clause 11.1, the Tutor shall not be liable for any indirect or consequential loss, or for any loss, damage, or expense arising from:

  • the Client’s failure to follow guidance or attend sessions;
  • examination outcomes; or
  • technical issues beyond the Tutor’s control.

11.3. Subject to Clause 11.1, the Tutor’s total liability to the Client arising out of or in connection with these Terms, however arising, shall not exceed the total fees paid by the Client in the 12 months before the event giving rise to the claim.

12. Force Majeure

12.1. The Tutor is not liable for any delay or failure to deliver a session caused by circumstances beyond the Tutor’s reasonable control, including illness, injury, power or internet outages, or other emergencies.

12.2. Where a session cannot be delivered for this reason, the Tutor will notify the Client as soon as reasonably possible and offer a rescheduled session or a credit towards a future session, at the Tutor’s discretion.

13. Privacy and Data Protection

13.1. The Tutor collects and processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Data Protection Act 2018, as set out in full in our Privacy Policy, available here, which forms part of these Terms.

13.2. Personal data (for example, name, email, and payment information) is used solely to provide the tuition services described in these Terms.

13.3. The Tutor does not disclose personal data to third parties except as required for payment processing, IT hosting, or legal compliance, as set out in the Privacy Policy.

13.4. Queries about the processing of personal data should be directed to our Data Protection Lead at [email protected].

14. Complaints

14.1. Any complaint about the tuition service should be sent in writing to [email protected], marked for the attention of the Senior Business Operations Officer, who will acknowledge it within 5 business days and aim to resolve it within 20 business days.

14.2. This Clause does not affect the Client’s rights under applicable consumer legislation.

15. Governing Law and Jurisdiction

15.1. These Terms are governed by and construed in accordance with the laws of Ireland.

15.2. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the Irish courts.

16. Amendments

16.1. Rody O’Brien Legal Education may amend these Terms at any time. Updated versions will be provided to Clients by email or published on the official website.

16.2. Continued participation in tuition services after an amendment takes effect constitutes acceptance of the updated Terms.

17. Severability

17.1. If any provision of these Terms is found by a court or other competent authority to be invalid or unenforceable, that provision will be treated as removed, and the remaining provisions will continue in full force and effect.

18. Entire Agreement

18.1. These Terms, together with the Policies referred to, constitute the entire agreement between Rody O’Brien Legal Education and the Client, superseding any prior communications, representations, or agreements as of the effective date above.
